These limitations apply regardless of the legal theory on which the claim is based, including contract, tort, negligence, strict liability, or otherwise, and even if Dewey's Pizza has been advised of the possibility of such damages. Some states do not allow the limitation of liability for certain types of damages, so some of the above limitations may not apply to you.
11. Indemnification
You agree to defend, indemnify, hold harmless, and release Dewey's Pizza, its parent companies, subsidiaries, affiliates, officers, directors, shareholders, employees, agents, contractors, licensors, service providers, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
